These Terms of Service ("Terms") govern your access to and use of our website, mobile application, and AI-powered therapeutic support services (collectively, the "Services"). Peacify provides a subscription-based AI companion for mental and emotional support, powered by advanced AI models like Google Gemini. Our service is designed to offer a confidential space for users to explore their thoughts and feelings.

IMPORTANT: Peacify is not a licensed medical or healthcare provider and does not provide medical advice, diagnosis, or treatment. The Services are not a substitute for professional mental healthcare. In case of a mental health crisis or emergency, please contact a qualified healthcare provider or your local emergency services (e.g., 911 or 988 in the US) immediately.

2. User Accounts and Eligibility

• You must be at least 18 years old to create an account and use our Services.
• You are responsible for providing accurate information during registration and our onboarding process.
• You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3. Subscriptions and Payments

• Subscription-Based Service: Access to Peacify's core features requires a paid subscription. We may offer different subscription plans, including a free tier with limited functionality, as detailed on our pricing page.
• Payment Processing: We use iyzico as our third-party payment processor. By subscribing, you agree to iyzico's terms and authorize us, through iyzico, to charge your chosen payment method on a recurring basis (monthly or annually) until you cancel.
• Cancellation: You may cancel your subscription at any time through your account's billing settings. Your access to paid features will continue until the end of your current billing period. To avoid being charged for the next period, you must cancel before the renewal date.
• Price Changes: We reserve the right to change our subscription plans or adjust pricing. We will provide you with reasonable prior notice of any price changes.

4. User Conduct and Content

• You are solely responsible for the content of your conversations with the AI and your conduct while using the Services.
• You agree not to use the Services for any unlawful purpose or to share content that is illegal, harmful, or infringes on the rights of others.
• We reserve the right to suspend or terminate your account if you violate these Terms.

5. Crisis Detection

Our Services include a safety feature designed to detect patterns in conversation that may indicate a user is in crisis. If a crisis is detected, the AI may provide immediate safety information and resources, such as emergency contact numbers. This is a supportive feature and not a guarantee of intervention or a substitute for professional crisis services.

6. Privacy and Data Security

Your privacy is critically important to us. Our collection and use of your personal information, including sensitive data provided during onboarding and your conversation history, is governed by our Privacy Policy. Please review it carefully to understand our practices.

7. Intellectual Property

• All content, branding, and technology related to the Peacify Services, including our website and application, are the exclusive property of Peacify and its licensors. You are granted a limited, non-exclusive, revocable license to use the Services for your personal, non-commercial use.

8. Disclaimers and Limitation of Liability

The Services are provided on an "as is" and "as available" basis without any warranties, express or implied. Peacify does not warrant that the service will be uninterrupted, error-free, or meet your specific needs.

To the fullest extent permitted by law, Peacify shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, resulting from your use of the Services.

These Terms shall be governed by and construed in accordance with the laws of Germany, without regard to its conflict of law principles.
